1. Acceptance of Terms

By accessing or using PitchAgent (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Nature of Service

PitchAgent is a job aggregation platform and AI writing assistant. The Service collects publicly available job postings and freelance opportunities from various third-party RSS feeds and presents them in a unified interface for your convenience. PitchAgent also provides AI-powered tools to help you draft proposals and similar professional documents.

PitchAgent does not offer employment, act as a recruiting agency, or serve as an intermediary between freelancers and clients. We are a productivity tool only. All hiring decisions and contractual agreements are strictly between you and the hiring party on the original platform.

3. AI-Generated Content Disclaimer

The generated content (Proposals, PDFs, and related outputs) is created by Artificial Intelligence. While the AI strives for accuracy and professionalism, it is a probabilistic language model. By nature, AI may produce inaccurate, misleading, offensive, or nonsensical text — commonly referred to as “hallucinations.”

YOU are solely responsible for reviewing, editing, and approving all AI-generated content before sending it to any client, employer, or third party. Sending unreviewed AI output is done entirely at your own risk.

PitchAgent is not liable for any lost opportunities, reputational damage, contractual disputes, or any other damages resulting from the use of AI-generated content. The AI is a tool; the final responsibility for all communications lies with the user.

4. No Income Guarantees

We provide tools to assist your freelance workflow, but we make NO guarantees regarding job offers, income, revenue, or success rates. Results depend entirely on your skills, market conditions, and external factors beyond our control.

Any testimonials, case studies, or examples shown on the platform are for informational purposes only and should not be interpreted as a promise of similar results. Past performance does not guarantee future results.

5. Third-Party Data & External Platforms

We aggregate data from public RSS feeds provided by third-party platforms including, but not limited to, Upwork, WeWorkRemotely, RemoteOK, Reddit, ProBlogger, and Dribbble. We are not responsible for the accuracy, validity, legality, or safety of these external job postings.

Job listings may be outdated, filled, fraudulent, or otherwise unavailable by the time you view or respond to them. Beware of scams on third-party platforms. Never pay upfront fees, share sensitive financial information, or agree to work without proper due diligence.

PitchAgent does not endorse, verify, or guarantee any third-party job listing, employer, or project displayed within the Service.

6. Subscription & Payment

PitchAgent offers both free and paid subscription plans. All paid subscriptions are processed through Lemon Squeezy, which serves as our Merchant of Record. By subscribing to a paid plan, you agree to Lemon Squeezy's Terms of Service in addition to ours. Lemon Squeezy handles all payment processing, tax collection (VAT/GST/Sales Tax), and compliance on our behalf.

Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

7. Refund Policy

We want you to be satisfied with PitchAgent. If you are not happy with your purchase, the following refund terms apply:

  • 14-Day Money-Back Guarantee: You may request a full refund within 14 days of your initial purchase or renewal, no questions asked.
  • After 14 Days: Refunds are evaluated on a case-by-case basis. We may offer a prorated refund for the unused portion of your subscription if there are extenuating circumstances.
  • Free Plan: No refund applies to the free tier, as no payment is collected.

How to Request a Refund: Email support@pitchagent.co with your account email and the reason for your request. Refunds are typically processed within 5–10 business days and will be issued to the original payment method via Lemon Squeezy.

Chargebacks: If you initiate a chargeback or payment dispute instead of contacting us directly, your account will be immediately suspended and you may be permanently banned from the Service.

8. User Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to scrape, copy, or redistribute content from the Service without permission; (c) interfere with or disrupt the Service infrastructure; (d) create multiple accounts to abuse free tier limits; (e) share account credentials with unauthorized parties; (f) use the AI proposal tool to generate spam, phishing content, or any other form of abusive communication.

9. Intellectual Property

The PitchAgent name, logo, and original platform content are protected by intellectual property laws. Third-party job listings remain the property of their respective owners. You may not reproduce, distribute, or create derivative works based on the Service without our express written consent. AI-generated proposals are created for your personal professional use and you retain ownership of the final edited output.

10. Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHAGENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Termination

We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, with or without notice. In particular, accounts that abuse the AI API, use the tool for spam or phishing, or violate these Terms in any way will be permanently banned. Upon termination, your right to use the Service will immediately cease.
